4. Use of the Online Store
4.1. The Customer selects the product or tour they wish to purchase or book in the online store.
4.2. In the case of a tour, the product page may include, in particular:
- the name of the tour;
- its description;
- duration;
- meeting point;
- available dates and times;
- language;
- participation fee;

4.4. The Customer is required to provide true, accurate and complete information.
4.5. Before submitting the order, the Customer may review and correct the information provided on the shopping cart and checkout pages. The rules applicable to electronic commerce require that customers be given the opportunity to identify and correct data-entry errors before submitting an order.
5. Formation of the Contract
5.1. The presentation of products and services in the online store does not in itself constitute a binding offer by the Service Provider to enter into a contract.
5.2. By clicking the button used to finalise the order or booking, the Customer makes an offer to enter into a contract.
5.3. The Service Provider confirms receipt of the order electronically.
5.4. The contract is concluded when the Service Provider confirms the order or booking.
5.5. If the Customer does not receive confirmation within 48 hours of submitting the order at the latest, the Customer is no longer bound by their offer.
5.6. A contract concluded electronically is not regarded as a contract signed in paper form. The Service Provider processes the order data in its electronic system in accordance with the applicable legal and data protection requirements.
6. Prices and Currency
6.1. The prices of products and services in the online store are determined and displayed in euros (EUR).
6.2. Actual payment is made in Hungarian forints (HUF).
6.3. The conversion of prices stated in EUR into HUF is based on the EUR/HUF reference exchange rate published by the European Central Bank (ECB).
6.4. For the conversion, the latest EUR/HUF reference exchange rate published by the ECB and available at the time the order is finalised will be applied, plus 2%.
6.5. The actual amount payable by the Customer in Hungarian forints is displayed before the order is finalised.
6.6. If the ECB has not yet published a new exchange rate on the relevant day, the most recently published reference exchange rate will apply.
The ECB usually updates its euro reference exchange rates on business days at approximately 16:00.
6.7. The price of an order already confirmed will not be affected by subsequent changes in the exchange rate.
7. Payment
7.1. Online bank card payments are processed through the Barion system. Bank card details are not disclosed to the merchant.
The service is provided by Barion Payment Zrt., an institution supervised by the Central Bank of Hungary (Magyar Nemzeti Bank). Its licence number is: H-EN-I-1064/2013.
7.2. During the payment process, the Customer uses the payment interface provided by Barion.
7.3. Bank card details required for card payments are processed by Barion. Barion's own data protection rules apply to data processed during the payment transaction.
7.4. The Customer receives electronic confirmation of a successful payment.
7.5. In the event of an unsuccessful payment, the order or booking will not be regarded as paid until the payment has been successfully completed.
8. Invoicing
8.1. The Service Provider issues an invoice for the purchase in accordance with the applicable legislation.
8.2. The Customer is responsible for the accuracy of the billing information provided.
8.3. Where an electronic invoice is issued, it will be sent to the e-mail address provided by the Customer.
9. Tour Bookings
9.1. A booking may only be made for the available dates and times advertised on the page of the relevant tour.
9.2. It is the Customer's responsibility to select the correct date and time, number of participants and service.
9.3. The detailed content, duration and meeting point of the tour are specified in the description of the relevant tour and in the booking confirmation.
9.4. The Customer must arrive at the specified meeting point by the scheduled start time of the tour.
9.5. The Service Provider may make reasonable changes to the route or programme of the tour where justified by traffic conditions, events, road or area closures, official measures, weather conditions or other objective reasons, provided that the essential nature of the service is not changed.
10. Cancellation of Tours by the Customer
10.1. The Customer may cancel the tour in writing, preferably by e-mail to berta.zsuzsanna.bp@gmail.com.
10.2. The time of cancellation is the time at which the cancellation notice is received by the Service Provider.
10.3. To avoid misunderstandings, cancellation deadlines are calculated backwards in hours from the advertised starting time of the tour.
Cancellation Fees
a) At least 5 days – i.e. at least 120 hours – before the start of the tour:
Cancellation is free of charge.
b) Less than 5 days but more than 72 hours before the start of the tour:
25% of the guiding fee is payable.
c) No more than 72 hours but more than 24 hours before the start of the tour:
50% of the guiding fee is payable.
d) In the case of cancellation no more than 24 hours before the start of the tour, or failure to attend without cancellation:
100% of the price of the ordered service is payable.
10.4. If the Customer has already paid the full price of the service in advance, the Service Provider will refund the remaining amount after deducting the applicable cancellation fee.
10.5. Refunds will be made using the original payment method unless otherwise agreed by the parties.
11. Tour Bookings and the 14-Day Right of Withdrawal
11.1. A sightseeing tour booked for a specific date and time is a leisure service to be provided on a specified date or during a specified period.
11.2. In the case of such a service, the Consumer is not entitled to the 14-day right of withdrawal without giving a reason that would otherwise apply to distance contracts where the contract provides for a specific date or period of performance.
11.3. Cancellation of tour bookings is therefore governed by the cancellation rules set out in Section 10 of these Terms and Conditions. The applicable legislation expressly treats leisure services provided on a specific date as an exception.
12. Weather
12.1. Tours also take place in rainy weather.
12.2. Rain in itself does not constitute a circumstance entitling the Customer to cancel free of charge under conditions different from those specified in these Terms and Conditions.
12.3. Participants are responsible for wearing appropriate clothing and bringing suitable equipment for the weather conditions.
12.4. However, if weather conditions endanger the safety of participants or make it objectively impossible to conduct the tour, the Service Provider may modify, postpone or cancel the tour.
13. Cancellation of the Tour by the Service Provider
13.1. If the Service Provider is unable to conduct a booked tour, the Customer will be informed as soon as possible.
13.2. If a tour is cancelled by the Service Provider, the Customer may choose either:
- another available date and time; or
- a full refund of the amount paid for the cancelled tour.
13.3. As a general rule, refunds will be made using the original payment method.
14. Late Arrival and Failure to Attend
14.1. The Customer must arrive by the advertised start time.
14.2. In the event of a delay, the Customer should inform the Service Provider immediately wherever possible.
14.3. In the case of a group tour, the Service Provider is not required to delay the start of the tour because of a late participant.
14.4. Any loss of service caused by the Customer's late arrival or failure to attend does not constitute defective performance by the Service Provider.
14.5. In the event of failure to attend without cancellation, the full price of the service is payable.
15. Physical Products
15.1. The Service Provider may sell physical products in the online store, in particular souvenirs and products related to Budapest or the guided tour services offered.
15.2. The product page will display, in particular:
- the name of the product;
- its main characteristics;
- its price;
- any available variants;
- stock information;
- the conditions of collection.
15.3. In the event of an obvious data or pricing error, the Service Provider is not required to fulfil the order under the incorrectly displayed conditions. In such a case, the Customer will be informed of the correct information.
16. Personal Collection of Physical Products
16.1. Physical products purchased through the online store are collected in person.
16.2. The Customer will be informed of the place and possible arrangements for personal collection before finalising the order and in the order confirmation.
16.3. No separate delivery charge applies to personal collection.
16.4. The product is deemed to have been delivered when it is actually collected by the Customer or by a person authorised by the Customer.
17. Right of Withdrawal for Physical Products
17.1. In the case of physical products purchased through the online store, the Consumer – subject to the exceptions provided by law – has the right to withdraw without giving any reason within 14 days of receiving the product.
17.2. The Consumer may exercise the right of withdrawal by means of a clear statement to that effect.
The notice of withdrawal may be sent:
By e-mail: berta.zsuzsanna.bp@gmail.com
By post:
Berta Zsuzsanna Mária e.v.
1191 Budapest, Szabó Ervin utca 31. II/1. 12.
17.3. The withdrawal deadline is deemed to have been met if the Consumer sends the notice of withdrawal before the expiry of the 14-day period.
17.4. The Consumer must return the product concerned by the withdrawal to the Service Provider without undue delay and no later than 14 days after communicating the withdrawal.
17.5. The direct cost of returning the product is borne by the Consumer unless the Service Provider has agreed to bear that cost.
17.6. The Consumer is liable only for any reduction in the value of the product resulting from use beyond what is necessary to establish the nature, characteristics and functioning of the product.
18. Exceptions to the Right of Withdrawal
18.1. The Consumer may not exercise the right of withdrawal in cases where the applicable legislation provides for an exception.
Such cases may include, in particular:
- products made according to the Consumer's instructions or expressly personalised at the Consumer's request;
- products that are not suitable for return for health protection or hygiene reasons after being opened;
- perishable goods or goods with a short shelf life;
- other cases specified by law.
The applicable legislation contains a detailed list of exceptions to the right of withdrawal.
19. Refunds Following Withdrawal from the Purchase of Physical Products
19.1. In the event of a valid withdrawal, the Service Provider will refund the amount paid by the Consumer for the product within the period specified by law.
19.2. Since physical products are collected in person under these Terms and Conditions, there are no separate delivery costs to be refunded.
19.3. The Service Provider may withhold the refund until the product has been returned or until the Consumer has provided reliable evidence that it has been sent back, unless the Service Provider has undertaken to collect the product itself.
19.4. The refund will be made using the same payment method as the original payment unless the Consumer expressly agrees to another method.
